NEW DELHI: Delhi HC on Friday questioned maintainability of the defamation suit filed by IRS officer Sameer Wankhede , seeking an injunction and takedown of his portrayal in the Aryan Khan-directed Netflix series 'The Ba***ds of Bollywood'.
Justice Purushaindra Kumar Kaurav asked Wankhede how his suit was maintainable in Delhi and if cause of action arose in the national capital. Wankhede's counsel, advocate Sandeep Sethi, submitted that HC's jurisdiction was justified since the series was viewed in Delhi and various posts and reactions targeting Wankhede had emerged from individuals in the city.
"Your plaint is not maintainable here in Delhi. Look at the cause of action jurisdiction. If your case was that you were defamed at various places, including Delhi, and maximum damage occurred in Delhi, we would have understood and still considered the matter here," HC said.
Wankhede moved HC on Thursday with the defamation suit for alleged misleading portrayal of anti-drug enforcement agencies. tnn
